Pot Laws in Nevada
Decriminalization laws have not been passed in Nevada. Several distinctions are made, regarding age, in their laws governing severity of possession charges; but do not apply to other charges for distribution and/or cultivation of marijuana. For those who are 21 and older, a first time offense for possession of less than 1 ounce of marijuana is a misdemeanor and will bring a sentence of mandatory rehabilitation and a fine of $600. Repeat offenders in this age bracket who have four and other subsequent charges will receive felony convictions and spend 1-4 years in prison, with a fine of $5000 (per conviction).
Distribution and/or cultivation of less than 100 pounds of marijuana is a felony charge, and first offenders receive penalties of 1-6 years in prison and $20,000 fines. Second offense, for the same amounts, are punishable by 2 to 10 years in prison and $20,000.00 fines. For those convicted of a third (and subsequent) time are sentenced to 3 to 5 years in prison and $20,000.00 fines.
Sales of any amount of marijuana to a minor (first offense) will bring felony charges, sentenced to 1-20 years in prison and a fine determined by the courts. A second offense for this charge may be punishable by life in prison and fines determined by the courts. Distribution/cultivation within 1000 feet of schools or other specific areas brings an additional felony conviction, doubling all sentencing as listed above.
Medical Marijuana in NV
In order to obtain medical marijuana in Nevada, a patient must register with the Nevada Medical Marijuana Program (NMMP). Dispenseries are now available that sell medical marijuana. A patient can also grow his or her own and may possess three mature plants, (mature plants are those determined as over 12 inches in height or diameter, and showing signs of flowering), four immature plants (those less than 12 inches in height or diameter and not in flower), and one ounce of dried marijuana. Rare occasions may allow a prescribing physician to increase amounts permitted.
